This Vehicle Rental Service Policy ("Policy") governs the usage, responsibilities, and operational rules applicable to all vehicle rentals booked through VahanMart, operated by **Ommify Technologies Pvt. Ltd.**, having its registered office at:

This Policy forms an integral part of the Terms & Conditions and must be read along with the Payment & Refund Policy and Privacy Policy.

1. ROLE OF PLATFORM

  • VahanMart acts as a **technology-enabled marketplace** connecting Users (renters) with Vendors (vehicle providers).
  • The Company does **not own or operate vehicles**, unless explicitly stated.
  • The rental agreement is primarily between the **User and the Vendor**.

2. ELIGIBILITY FOR RENTAL

Users must:

  • Be at least 18 years of age (or as per legal driving age requirements)
  • Possess a **valid driving license** (India or International Driving Permit, as applicable)
  • Provide valid government ID proof
  • Pass KYC/verification checks if required

The Company reserves the right to deny bookings if verification fails.

3. BOOKING & CONFIRMATION

  • Bookings are confirmed only after **successful payment**
  • Users must review vehicle details, inclusions, and terms before booking
  • Any special requirements must be communicated at the time of booking

4. VEHICLE USAGE RULES

Users agree to:

  • Use the vehicle **only for lawful purposes**
  • Not use the vehicle for:
  • Illegal activities
  • Racing, stunts, or off-road use (unless explicitly allowed)
  • Sub-renting or commercial use without permission
  • Follow all traffic laws and regulations

5. DRIVER RESPONSIBILITY

  • Only the **authorized driver(s)** may operate the vehicle
  • Driver must carry valid documents at all times
  • Any violation (traffic fines, penalties, challans) is the **User’s responsibility**

6. VEHICLE CONDITION & INSPECTION

6.1 At Pickup

  • Users must inspect the vehicle at the time of delivery/pickup
  • Any existing damages must be reported immediately

6.2 During Rental

  • User must maintain the vehicle in reasonable condition
  • Regular checks (fuel, tire, etc.) are the User’s responsibility

6.3 At Return

  • Vehicle must be returned in the same condition (excluding normal wear & tear)

7. FUEL POLICY

  • Fuel policy (full-to-full / as provided) will be specified in booking details
  • Any deviation may result in additional charges

8. RENTAL PERIOD & EXTENSION

  • Rental duration is as per confirmed booking
  • Late return may attract **additional hourly/daily charges**
  • Extension requests must be made in advance and are subject to availability

9. SECURITY DEPOSIT

  • A refundable **security deposit** may be required
  • Deposit amount and conditions will be shown at booking
  • Deductions may be made for:
  • Damages
  • Late return
  • Traffic violations

10. DAMAGE & LIABILITY

  • User is responsible for any damage during the rental period
  • Insurance (if applicable) will be subject to policy terms
  • Costs not covered by insurance must be borne by the User

11. ACCIDENTS & BREAKDOWNS

In case of accident or breakdown:

  • Inform the Vendor and VahanMart immediately
  • Do not abandon the vehicle
  • Cooperate with insurance and legal processes

The Company is not liable for losses arising from such incidents.

12. INSURANCE

  • Vehicles may be covered under third-party/comprehensive insurance
  • Coverage details vary by Vendor
  • User must comply with all insurance conditions

13. CANCELLATION & REFUND

  • Governed by the **Payment Terms & Refund Policy**
  • Special bookings (e.g., Chardham, Leh trips) are **non-refundable**

14. PROHIBITED CONDUCT

Users shall not:

  • Drive under influence of alcohol/drugs
  • Overload the vehicle beyond capacity
  • Tamper with vehicle systems
  • Use forged documents

Violation may result in:

  • Immediate termination of rental
  • Forfeiture of deposit
  • Legal action

15. VENDOR OBLIGATIONS

Vendors are responsible for:

  • Providing roadworthy, insured vehicles
  • Accurate listing details
  • Timely delivery and support

16. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • The Company is not liable for:
  • Accidents or injuries
  • Vehicle performance issues
  • Third-party disputes

17. INDEMNITY

User agrees to indemnify the Company against claims arising from:

  • Misuse of vehicle
  • Legal violations
  • Breach of this Policy

18. FORCE MAJEURE

The Company shall not be liable for failure to perform due to events beyond control, including:

  • Natural disasters
  • Government restrictions
  • Strikes or disruptions

19. GOVERNING LAW

This Policy shall be governed by the laws of India. Courts in New Delhi shall have jurisdiction.
